Terms and conditions

Last updated: March 30, 2026. These terms govern your use of the Peak 14 Solutions website at peak14.net (the “Site”) and, if you enroll, our SMS text message program. They do not replace a signed statement of work, master services agreement, or other contract for professional services.

1. Agreement

By accessing or using the Site, you agree to these terms. If you do not agree, do not use the Site or program. We may update these terms; the “Last updated” date will change, and continued use after changes constitutes acceptance unless we require otherwise by law.

2. SMS text message program

The following applies if you opt in to receive text messages from Peak 14 Solutions. Our privacy practices for SMS are described in our privacy policy.

Program name: Peak 14 Solutions SMS

Program description: We send text messages with service-related updates, announcements, and other information about Peak 14 Solutions that you have requested or agreed to receive. Content may include reminders, event or product information, and replies to your inquiries as part of the program.

Message and data rates: Message and data rates may apply depending on your mobile carrier and plan. Carriers are not liable for delayed or undelivered messages.

Message frequency: Frequency varies. You may receive multiple messages when you first opt in or during an active project or campaign, and periodic messages thereafter—typically no more than a few messages per month when there is no active one-time sequence, unless you request more or we are responding to you.

Opt-out: You may cancel SMS messages at any time. Reply with STOP to the number that sent you the message to opt out. You will receive a one-time confirmation. Reply with HELP for information about the program or how to contact us.

3. Use of the Site

You agree to use the Site only for lawful purposes and not to:

Attempt to disrupt, scan, or gain unauthorized access to our systems or data
Transmit malware, spam, or misleading or fraudulent content through the Site or our contact channels
Misrepresent your identity or affiliation
Scrape or harvest the Site in a way that impairs performance or violates applicable law

4. Information on the Site

Content on the Site is for general information about Peak 14. It is not legal, financial, or other professional advice, and it may not reflect every nuance of how we deliver services to a particular client. Any engagement is subject to mutual agreement, scope, and fees as separately documented.

5. Intellectual property

The Site, including text, layout, branding, and logos (except third-party marks), is owned by Peak 14 or its licensors. You may not copy, modify, or distribute Site content for commercial use without our prior written permission, except as allowed by law (e.g. fair use).

6. Disclaimer of warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK 14 AND ITS TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SITE (OTHER THAN CLAIMS THAT CANNOT BE LIMITED UNDER APPLICABLE LAW) WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE AMOUNT YOU PAID US, IF ANY, SPECIFICALLY FOR ACCESS TO THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM—WHICH IS TYPICALLY ZERO FOR PUBLIC WEBSITE USE.

8. Indemnity

You agree to defend and indemnify Peak 14 against claims arising from your misuse of the Site, your violation of these terms, or your violation of third-party rights, except to the extent caused by our willful misconduct.

9. Governing law and venue

These terms are governed by the laws of the State of Colorado, USA, without regard to conflict of law principles. Exclusive jurisdiction and venue for disputes arising from these terms or the Site (where permitted) shall be in the state or federal courts located in Colorado; you consent to personal jurisdiction there.

10. Severability

If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
